Terms & Conditions – Momoco Design Solution

Please read these Terms and Conditions (“Terms”, “Terms and Conditions”) carefully before engaging our services or using the website operated by Momoco Design Solution (“us”, “we”, or “our”), situated at 32G, Jalan Sungai Burung AA32/AA, Bukit Rimau, 40460 Shah Alam, Selangor, Malaysia.

By accessing our website, placing an order, or confirming a quotation, you agree to be bound by these Terms. If you disagree with any part of these terms, please do not proceed with our services.

1. Scope of Services

Momoco Design Solution provides one-stop integrated printing and design services. Our offerings include, but are not limited to, creative graphic design and layout conceptualization, multi-colour offset and digital printing, label stickers, loose sheets (flyers, brochures, leaflets), business cards, NCR bill books, packaging boxes, and corporate gifts. All printed items are customized and made to order based on agreed customer requirements.

2. Eligibility

You must be at least 18 years old or acting under the supervision of a parent or legal guardian to place an order. By placing an order, you warrant that you possess the legal capacity to enter into binding agreements.

3. Design Services, File Submission, and Final Proof Approval

Customer-Supplied Artwork: If you supply your own design files, you are solely responsible for ensuring files are print-ready (CMYK colour format, minimum 300 DPI resolution, correct dimensions, bleeds, and safe margins). We are not responsible for visual defects caused by low-resolution images, RGB-to-CMYK colour shifts, incorrect dimensions, or grammatical errors present in customer-submitted files.
In-House Graphic Design Services: Where design or layout services are commissioned from Momoco Design Solution, digital proofs will be sent for your review and approval via email or messaging platforms (e.g., WhatsApp).
Final Approval: Production begins only upon final artwork confirmation. Once approval is given by the customer, Momoco Design Solution shall not be held liable for any overlooked typos, incorrect text, layout issues, or design discrepancies.

4. Orders and Payment

Payment Terms: Orders require full payment (or an agreed deposit for corporate accounts) before design conceptualization or production commences.
Currency: All prices quoted are in Malaysian Ringgit (MYR).
Order Modifications & Cancellations: Because all jobs are customized, orders cannot be cancelled, modified, or refunded once payment is processed and the job has entered the design or print production queue.

5. Production Turnaround and Delivery

Turnaround Times: Estimated completion and production schedules are provided for guidance and are not strict guarantees. Delays may occasionally arise due to equipment maintenance, drying times for multi-colour print runs, material supply shortages, or public holidays.
Collection & Delivery: Customers may choose self-collection at our Bukit Rimau premise or opt for courier dispatch.
Third-Party Logistics: While we work with reliable third-party shipping couriers and assist with tracking, Momoco Design Solution is not liable for parcels delayed, lost, or damaged in transit once handed over to the courier service.

6. Reprints and Quality Claims

Custom Goods Policy: Due to the bespoke nature of printed materials, no monetary refunds are provided once production has taken place.
Defect Notifications: If you receive an order with manufacturing defects or printing errors attributable solely to our production process (excluding errors present in customer-approved proofs), you must notify us within three (3) working days of receiving the items at [email protected] or via our official WhatsApp channels.
Assessment: All claims must include clear photographic or video evidence. At our discretion, we may request the return of the defective batch before approving an authorized reprint.

7. Intellectual Property and Content Rights

You retain ownership of all intellectual property, logos, and materials submitted to us. By submitting artwork, you grant Momoco Design Solution a non-exclusive license to use and reproduce the materials strictly to produce and fulfill your order.
You warrant that any text, trademarks, artwork, or graphics supplied do not infringe on the copyright, trademark, or intellectual property rights of any third party.
Momoco Design Solution reserves the right to decline any order containing obscene, defamatory, infringing, or unlawful content.

8. Limitation of Liability

Momoco Design Solution shall not be liable for any indirect, incidental, special, or consequential damages—including loss of business profits, project deadlines, or commercial opportunities—arising from the use of our services or potential delays in delivery. Our maximum cumulative liability shall in no event exceed the total amount paid by the customer for the specific product or service in question.

9. Privacy Policy

Any personal data collected during the order, design, and delivery process (such as names, contact numbers, delivery addresses, and billing information) is handled with care and used exclusively for service fulfillment, communication, and invoicing purposes in accordance with the Malaysian Personal Data Protection Act (PDPA).

10. Governing Law

These Terms and Conditions shall be governed by and construed in accordance with the laws of Malaysia. Any legal dispute arising under these Terms shall be subject to the exclusive jurisdiction of the courts of Malaysia.
